TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) are an agreement between you and Harwell Home Improvements, LLC, doing business as Interiors by Angie (“we,” “us,” or “our”). They govern your use of https://www.interiorsbyangie.com and any related pages, forms, and tools, and they govern the calls, emails, and text messages you request from us.
By using the website, submitting a form, or opting in to messages, you agree to these Terms and to our Privacy Policy at https://www.interiorsbyangie.com/privacy-policy/. If you do not agree, do not use the site and do not opt in.
Our SMS program is written to comply with the Telephone Consumer Protection Act (TCPA), Campaign Registry requirements, and CTIA Best Practices. How we handle personal information is described in the Privacy Policy. These Terms control the program rules.

2. Who may use the website
You must be at least 18 years old and able to form a binding contract. You may use the site only for your own personal, non-commercial inquiry about flooring or related home improvement, or as we otherwise allow. You agree that information you submit is accurate and that the phone number and email you give us belong to you or that you are authorized to use them.
3. The website
The website is for information about flooring, bath and kitchen products and installation and for requesting a quote or appointment. We may change, suspend, or take down content or features at any time. We do not warrant that the site will be error-free, uninterrupted, or free of harmful code. You are responsible for your own device, browser, and internet connection.
We grant you a limited, revocable, non-exclusive license to view the site for those purposes. You may not copy, scrape, reverse engineer, frame, or republish the site, flood it with automated requests, or use it to send spam or to break the law.
4. Quotes, design visits, and flooring, bath and/or kitchen work
A quote request, a website form, or an in-home visit is not a contract to perform work. Prices, photos, product names, and descriptions on the website are examples. They may change, and they may not match a particular house.
Any flooring or related home-improvement work is done only under a separate written agreement that you and we both sign. Warranties, payment terms, start dates, and scope live in that agreement, not on the website. If these Terms and a signed work contract conflict on the job itself, the signed contract controls. Wisconsin home-improvement practices, including Wis. Admin. Code ch. ATCP 110, may also apply to that written contract.
We may offer financing through third-party lenders (including programs marketed as Smart Choice Financing). A lender has its own application, credit decision, and contract. Submitting a financing inquiry on our site is not an approval and is not a loan from us. Financing partners will not text you under our name.
5. Text messages and other contact
If you opt in, you agree that we may contact you at the number and email you give us, including by text, for marketing and for job status. That includes follow-up on products or services, scheduling of appointments, estimates, measurements, or installations, delivery of quotes, promotional information or special offers, and updates about a job.
You may opt in by website or electronic checkbox, by verbal consent after a disclosure is read to you, by signing a paper or in-person form, or by email.
Message frequency varies and will not be more than 3 to 5 messages per day unless a notification event occurs. Message and data rates may apply. Contact your carrier for details. Availability depends on your carrier and device. We do not guarantee delivery or timing.
One-to-one consent. Your opt-in is consent to receive messages from Harwell Home Improvements, LLC, doing business as Interiors by Angie only. We do not share that consent with third parties or affiliates unless you expressly agree. Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Other companies will not text you under our name.
National Do Not Call Registry protections apply to SMS. We honor existing DNC registrations unless you expressly opt in.
Consent is not a condition of purchase or of receiving a quote. You may use our services without joining the SMS program.
Text STOP to any message to cancel. Text HELP for help. You may also opt out by calling (920) 305-7073 or 1-800-NEW-FLOORS, or by emailing Info@floorsbyangie.com. After a STOP request we will send a one-time confirmation and then stop marketing texts to that number. Transactional texts about an existing job may still be sent where the law allows.
You represent that the number you provide is your mobile number, that you are the subscriber or customary user, and that you will tell us if the number changes or is reassigned.
6. Electronic communications
If you give us an email address or opt in to texts, you agree that we may send notices, estimates, and other communications electronically. Electronic records and signatures have the same effect as paper. You may withdraw consent to electronic notices by emailing Contact@floorsbyangie.com, but we may then need to communicate by mail and some website features may not be available.
7. User content
If you send us photos, measurements, reviews, or other content, you grant us a non-exclusive right to use that content to respond to you and to perform a job. If we want to use a photo or review in our advertising, we will ask you first. Do not send content you do not have the right to send. We may refuse or delete content that is unlawful or unrelated to the request.
8. Intellectual property
The website, logos, photos, drawings, and text belong to us or our licensors. You may not copy or reuse them without our written permission, except for ordinary viewing of the site. Product names of manufacturers appear for identification. Those marks belong to their owners.
9. Third-party links
The site may link to lenders, manufacturers, maps, or social media. We are not responsible for those sites. Their terms and privacy policies apply to what you do there.
10. Disclaimer
The website and messages are provided as is. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement as to the website and as to messages. This disclaimer does not take away any warranty in a signed flooring or home-improvement contract.
11. Limit of liability
To the extent the law allows, we are not liable for indirect, incidental, special, or consequential damages arising from use of the website or from messages, including lost data or lost profits, even if we were told they were possible. Our total liability arising from the website or from messages is limited to fifty dollars ($50). This section does not limit liability that Wisconsin law does not allow us to limit, and it does not change any warranty or damage term in a signed work contract.
12. Indemnity
You agree to defend and indemnify us and our owners, employees, and agents against claims, damages, and reasonable attorneys’ fees that arise from your misuse of the website, from content you submit, or from your violation of these Terms.
13. Privacy
How we collect, use, and share information is described in our Privacy Policy: https://www.interiorsbyangie.com/privacy-policy/. Consent records are kept in our CRM. If these Terms and the Privacy Policy conflict on a data-handling point, the Privacy Policy controls that point.
14. Changes
We may update these Terms. Material changes will be communicated by SMS or on our website. The effective date at the top will change. Continued use after an update is acceptance of the new Terms.
15. Governing law and venue
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. Any dispute arising out of the website, these Terms, or messages must be brought in the state courts located in Outagamie County, Wisconsin, which is where our office at 2339 W. Wisconsin Ave., Appleton, WI 54914 is located. You and we consent to that venue.
16. General
These Terms and the Privacy Policy are the entire agreement between you and us about the website and about messages. They do not change a signed flooring or home-improvement contract. If a court finds a part of these Terms unenforceable, the rest remains in effect. A failure to enforce a term is not a waiver. You may not assign these Terms. We may assign them in connection with a sale of the business. Headings are for convenience only.
